1. Who we are

Botbooster is a WhatsApp-based AI automation service for businesses. Botbooster helps businesses automate WhatsApp communication, answer customer questions, manage business information, capture enquiries, tag conversations, score leads, connect calendars and integrate with selected third-party business tools.

In these Terms, “Botbooster”, “we”, “us” or “our” refers to:

By accessing our website, signing up for Botbooster, using a Botbooster-powered WhatsApp number, connecting an integration, submitting information to us or otherwise using our services, you agree to these Terms.

If you use Botbooster on behalf of a business, company, organisation or other legal entity, you confirm that you have authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not use Botbooster.

3. The Botbooster service

Botbooster provides AI-powered WhatsApp automation for businesses. Depending on your selected package, Botbooster may include:

4. Business WhatsApp number

Botbooster may provide or connect a WhatsApp Business number for your business, depending on your setup.

You are responsible for ensuring that your use of WhatsApp, customer communication and automated messaging complies with applicable laws, WhatsApp rules, Meta policies and any industry-specific obligations that apply to your business.

You acknowledge that WhatsApp and Meta are third-party services. Their availability, rules, pricing, approval processes, templates, limitations and policies may change from time to time. Botbooster is not responsible for outages, suspensions, restrictions, delivery failures or policy decisions made by WhatsApp or Meta.

5. Account registration and onboarding

To use Botbooster, you may need to provide information such as your name, surname, business name, cellphone number, email address, billing details, bot name, business information and other onboarding details.

You agree that all information you provide must be accurate, complete and up to date.

You are responsible for all activity that occurs under your account, business profile, WhatsApp number, connected integrations and authorised users.

6. Free trial

Botbooster may offer a free trial, promotional period or introductory offer.

Unless otherwise stated during sign-up:

Botbooster may change, withdraw or refuse free trials at any time, including where we suspect misuse, duplicate accounts, fraud or abuse.

7. Fees, billing and payment

You agree to pay all fees applicable to your selected Botbooster package, subscription, usage, setup, add-ons and integrations.

Unless otherwise stated, fees are exclusive of VAT, taxes, duties, bank charges, currency conversion costs and third-party provider charges.

You authorise Botbooster and/or its payment provider to charge your selected payment method for amounts due.

8. Price changes

We may change our pricing, packages, usage limits, trial terms or billing model from time to time.

Where required by law or where reasonably practical, we will provide notice of material pricing changes before they take effect.

Continued use of Botbooster after a pricing change takes effect means you accept the updated pricing.

9. Cancellations

You may cancel your Botbooster subscription by following the cancellation process provided by us or by contacting us at info@botbooster.co.za.

Cancellation will stop future billing, subject to any notice periods, minimum terms, unpaid amounts, usage charges or contractual commitments that apply to your account.

Unless otherwise required by law or expressly agreed in writing, fees already paid are non-refundable.

10. Failed payments

If payment fails, we may notify you and attempt to process payment again.

If payment remains unpaid, we may suspend, restrict or terminate access to Botbooster, including your WhatsApp bot, integrations, automation and support services.

You remain responsible for all unpaid fees, charges and costs incurred before suspension or termination.

Botbooster uses artificial intelligence to generate or assist with responses. AI-generated responses may be incorrect, incomplete, outdated or unsuitable in some circumstances.

You are responsible for the business information, documents, FAQs, prompts, integrations and instructions used by your bot.

You must not rely on Botbooster as a substitute for professional advice, including legal, financial, medical, tax, safety or regulatory advice.

You are responsible for reviewing, correcting and supervising your bot’s responses where necessary, especially where incorrect information could affect customers, bookings, payments, orders, legal obligations or safety.

14. No guarantee of results

Botbooster may help improve response speed, automation, lead handling and customer communication, but we do not guarantee any specific commercial result.

We do not guarantee that Botbooster will increase sales, revenue, leads, bookings, conversion rates, customer satisfaction or profitability.

15. Integrations

Botbooster may allow you to connect third-party services such as Google Calendar, Google Sheets, Google Drive, Dropbox, HubSpot, Zendesk, Salesforce, Mailchimp, Shopify and other platforms.

You authorise Botbooster to access, retrieve, send, update or process information through those integrations as required to provide the enabled functionality.

Third-party integrations are provided by third parties and are subject to their own terms, privacy policies, pricing, permissions, rate limits, outages and changes.

Botbooster is not responsible for third-party service failures, outages, data loss, API changes, pricing changes, permission changes or account suspensions.

16. Customer data

As between you and Botbooster, you retain ownership of the business data, customer messages, uploaded documents, FAQs and other content you provide to Botbooster.

You grant Botbooster a limited right to host, process, transmit, analyse, display and use that data as necessary to provide, secure, support and improve the service.

You are responsible for ensuring that you have all required rights, permissions, consents and lawful grounds to provide customer data to Botbooster and to process it through the service.

17. Privacy and data protection

Our processing of personal information is described in our Privacy Policy.

By using Botbooster, you agree that we may process personal information as described in the Privacy Policy and as necessary to provide the service.

If you use Botbooster to process personal information of your customers, leads, staff, contractors or other individuals, you are responsible for complying with applicable privacy and data protection laws.

18. Confidentiality

Each party may receive confidential information from the other. Confidential information includes business information, technical information, pricing, credentials, customer data, integration details, non-public product information and any information that should reasonably be understood as confidential.

Each party agrees to use confidential information only for the purpose of providing or using Botbooster and to take reasonable steps to protect it from unauthorised disclosure.

19. Security

We use reasonable technical and organisational measures to protect Botbooster and the information processed through it.

You are responsible for securing your own devices, accounts, WhatsApp access, email accounts, passwords, integrations and authorised users.

You must notify us promptly if you suspect unauthorised access, credential compromise, misuse of your bot, or a data security incident involving Botbooster.

20. Service availability

We aim to provide a reliable service, but we do not guarantee that Botbooster will always be available, uninterrupted, secure or error-free.

The service may be affected by maintenance, upgrades, infrastructure issues, third-party provider outages, WhatsApp or Meta issues, internet connectivity, API changes, misuse, force majeure events or other circumstances outside our control.

21. Changes to the service

We may add, change, suspend or remove features, packages, integrations, workflows or service functionality at any time.

We will try to avoid materially reducing core paid functionality without notice, but we may make urgent changes where required for security, legal compliance, third-party provider requirements or service stability.

22. Suspension and termination

We may suspend or terminate your access to Botbooster immediately if:

After termination, we may disable your bot, stop automations, disconnect integrations and restrict access to account data.

23. Intellectual property

Botbooster, including its software, workflows, prompts, designs, interfaces, documentation, processes, code, branding, trade marks and related materials, belongs to Botbooster or its licensors.

These Terms do not transfer ownership of Botbooster intellectual property to you.

You may not copy, resell, sublicense, reverse engineer, reproduce or create competing services based on Botbooster without our written permission.

24. Feedback

If you provide suggestions, ideas, feature requests or feedback, you allow us to use them without restriction or compensation.

25. Publicity

Unless you tell us otherwise in writing, we may identify your business as a Botbooster customer using your business name and logo in customer lists, sales materials or website references.

26. Beta features

From time to time, we may offer beta, experimental or early-access features.

Beta features may be incomplete, unreliable, changed, withdrawn or made subject to additional terms. You use beta features at your own risk.

27. Disclaimers

Botbooster is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, representations and guarantees not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation and error-free performance.

28. Limitation of liability

To the maximum extent permitted by law, Botbooster will not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, revenue, goodwill, data, business opportunity, customers or anticipated savings.

To the maximum extent permitted by law, our total liability arising out of or relating to Botbooster or these Terms will be limited to the amount paid by you to Botbooster for the service in the three months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot legally be excluded.

29. Indemnity

You agree to indemnify and hold Botbooster harmless from claims, damages, losses, liabilities, costs and expenses arising from:

Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws where those rights cannot be lawfully limited.

If you use Botbooster for business purposes, you acknowledge that certain consumer protections may not apply in the same way as they would for individual consumer use.

31. Force majeure

We will not be liable for delay or failure to perform caused by events outside our reasonable control, including internet failures, power failures, hosting outages, labour disputes, natural disasters, war, civil unrest, regulatory action, cyberattacks, third-party platform failures, WhatsApp or Meta outages, or changes to third-party APIs or policies.

32. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

We may assign or transfer our rights and obligations under these Terms as part of a business transfer, restructuring, merger, acquisition, sale of assets or operational change.

33. Governing law

These Terms are governed by the laws of Republic of South Africa, unless another law is required to apply.

34. Disputes

If a dispute arises, you agree to first contact us so that we can try to resolve the matter informally.

If the dispute cannot be resolved informally, it will be handled by the courts or dispute resolution forum with jurisdiction under the laws of Republic of South Africa.

35. Changes to these Terms

We may update these Terms from time to time. The updated version will be published on our website with a new “Last updated” date.

Continued use of Botbooster after updated Terms are published means you accept the updated Terms.

36. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining parts will continue to apply.

37. No waiver

If we do not enforce any part of these Terms immediately, that does not mean we waive our right to enforce it later.

38. Entire agreement

These Terms, together with the Privacy Policy and any signed agreement or written order form between you and Botbooster, form the entire agreement between you and Botbooster regarding the service.
